Terms of service

The agreement between you and Pinnaki for using the app, the website and the API. Each section starts with a short summary; the full text below it is what applies.

1. Accepting these terms

In short

By using Pinnaki you accept these terms. If you sign up for a company, you confirm that you may accept them for it.

By creating an account, using Pinnaki or connecting channels to it, you agree to these terms, to the privacy policy and to the platform rules in section 4. If you accept them on behalf of a company, you confirm that you are authorised to do so, and “you” then means that company. If you do not agree, do not use Pinnaki.

2. The service

In short

A workspace for WhatsApp, Instagram, Messenger and Telegram. What you can use depends on your plan.

Pinnaki lets your business send campaigns, reply to customers in a Live Chat for each channel, build flows and use AI features on WhatsApp, Instagram, Messenger and Telegram. What you can use, and how much, depends on your plan; the limits that apply to you are shown in the app. We may add, change or remove features over time.

3. Your account

In short

Give accurate details, keep your sign-in safe, and remember that you are responsible for what happens in your workspace.

  • You must be at least 18, give accurate details and keep them up to date.
  • Keep your password safe. If you think someone else has used your account, change the password and write to support@pinnaki.com.
  • Admins decide who joins the workspace and with which role (admin, manager or agent). You are responsible for everything done in your workspace.
  • One account may not be shared between different organisations.

4. Meta’s, Telegram’s and Google’s rules

In short

Each channel has its own rules, and you must follow them. The channels can reject templates or block a number or bot on their own.

Every message must follow the rules of the channel it uses: for WhatsApp, Instagram and Messenger, Meta’s Commercial Terms, the WhatsApp Business Messaging Policy and Meta’s other platform policies; for Telegram, Telegram’s terms of service and its rules for bots; for the Google services you connect, Google’s API terms.

Meta and Telegram may approve or reject templates, limit how many people you can message, or restrict a number, page or bot. Those decisions are theirs, not ours.

5. Consent before you message, and no spam

In short

Message only people who agreed to hear from you, and stop as soon as they opt out.

  • Before you send promotional or outbound messages, get clear opt-in consent from each person and keep a record of it.
  • Honour opt-outs at once. Pinnaki applies your workspace’s opt-out keywords and WhatsApp’s marketing-message setting, but consent remains your responsibility.
  • Do not send unsolicited, misleading or abusive messages, and do not message lists you bought or rented.

Spam or abuse can lead to immediate suspension of the account (section 12).

6. Acceptable use

In short

No unlawful or harmful content, no deception, and no attacks on the service.

Do not use Pinnaki to:

  • send unlawful, fraudulent, deceptive, hateful or sexually explicit content, or content that infringes someone else’s rights;
  • impersonate a person or business, or trick people into giving away passwords, card details or one-time codes;
  • spread malware, access other workspaces, test our security without permission, or overload the service;
  • copy, resell or reverse engineer the service, except as far as the law allows.

Found a security issue? Report it to support@pinnaki.com.

7. Your content

In short

Your content stays yours. You allow us to process it only to run the service for you.

You own the contacts, messages, files and other content you put into Pinnaki. You allow us to store, process and transmit it only to provide the service to you, as the privacy policy describes. You are responsible for having the right to use that content and for its accuracy and lawfulness. Each workspace’s contacts and conversations are kept separate from every other workspace.

8. AI features

In short

AI output can be wrong. Check it before you rely on it.

AI features, such as template and flow drafts, AI agents and ads insights, write text automatically. That text can be inaccurate or incomplete. Review drafts before you send them, and decide for yourself whether an AI agent may answer your customers.

When your workspace uses its own AI provider key, that provider’s terms and charges apply, and drafts made with your own key are not charged to your wallet.

9. Billing and wallet

In short

You pay in advance from a prepaid wallet in rupees. Top-ups are non-refundable, except where the law requires a refund.

  • Pinnaki is prepaid. You top up your workspace’s wallet in rupees through Razorpay. We never charge a card automatically.
  • Plan fees and message and AI charges are paid from the wallet at the prices shown in the app and on the pricing page. WhatsApp prices follow Meta’s rate cards, which Meta changes from time to time.
  • A campaign reserves its estimated cost from the wallet before it sends, and the unused part is released when it ends. The wallet cannot go below zero.
  • Plans renew from the wallet. If the balance cannot cover a renewal, paid plan features stop until you top up and the renewal is paid. Upgrades are charged pro rata; downgrades and cancellations take effect at the end of the current period.
  • GST is added to the plan fee and shown on each invoice.
  • Wallet top-ups are non-refundable, except where the law requires a refund. Any balance left when a workspace is deleted is forfeited.

10. Data and privacy

In short

The privacy policy explains how we handle data. For your contacts’ data, we act on your instructions.

The privacy policy explains how we handle personal data. For the personal data of your contacts, your business is the Data Fiduciary and we process it on your behalf, following your instructions in the app. You are responsible for giving your contacts the notices, and for getting the consents, that the law requires.

11. API and fair use

In short

Stay within the API’s rate limits and your plan’s limits, and keep your API keys secret.

Integrations that use the developer API must stay within its rate limits and your plan’s limits, such as daily campaign limits and the number of channels. Attempts to overload webhooks or get around the limits are rate limited and can lead to suspension. Keep your API keys secret: you are responsible for every call made with them.

12. Suspension and closing

In short

You can close your workspace at any time. We may suspend it for serious breaches, risks to others or legal reasons.

You can deactivate or delete your workspace from its settings at any time, as the privacy policy describes.

We may suspend or close a workspace that breaches these terms or a channel’s rules, puts the service or other people at risk, or when the law requires it. Where we reasonably can, we will tell you first and give you a chance to fix the problem.

13. Third-party services

In short

The channels and integrations are run by other companies. Their outages and decisions are outside our control.

WhatsApp, Instagram, Messenger, Telegram, Razorpay, Google and the stores you connect are run by other companies under their own terms. Their outages, policy changes and decisions, such as rejecting a template or blocking a number, are outside our control.

14. Limitation of liability

In short

The service is provided as it is. We are not liable for indirect losses or for what other platforms do.

We work to keep Pinnaki running and correct, but we provide it as it is and as available, without a promise that it will be uninterrupted or free of errors.

As far as the law allows, Pinnaki is not liable for delivery delays on the networks downstream of us, for templates that Meta rejects, for outages of a third-party channel, or for indirect or consequential losses such as lost profits or lost data.

15. Indemnification

In short

If your messages or content lead to claims against us, you cover them.

You agree to indemnify Pinnaki and its affiliates, and hold them harmless, against third-party claims, penalties or damages that result from your breach of these terms or of messaging policies, or from your infringement of intellectual property.

16. Changes to these terms

In short

The date at the top shows the current version. We email account admins about important changes.

We may update these terms. The date at the top shows the current version, and we will email account admins about important changes before they take effect. If you keep using Pinnaki after that, the new terms apply.

17. Governing law

In short

Indian law applies.

These terms are governed by the laws of India. The courts that have jurisdiction will be named here after legal review.

18. Contact
